The Montana Department of Labor Industry indicates that payment of prevailing wage is required for public work projects that exceed $25,000. Montana’s prevailing wage law is referred to as the Little Davis-Bacon Act. According to the Little Davis-Bacon Act of Montana, each contractor must utilize at least 50% bona fide Montana residents among its workforce when working on public works projects.
Prevailing wage rates for the construction and service sectors are set by the Department of Labor & Industry’s Compliance and Investigations Bureau. Applicable rates are based on classifications under heavy, highway and building construction, and services.
